Privacy Policy

This Privacy Policy explains how Creova Creators LLC (“CREOVA”, “we”, “us” or “our”) collects, uses, shares and protects your personal data when you use the CREOVA platform (the “Platform”). Creova Creators LLC is a Florida limited liability company with principal address at 2 Biscayne, Suite 3200-6826, Miami, FL 33131, USA, and acts as the data controller for the personal data described below.

1. Information we collect

1.1 Information you provide

• Account data: name, email, phone number (E.164), password or OAuth identifier (Google), country, language.
• Profile data: public name, birthdate, gender, location, short description, creator categories, services, links to your Instagram, TikTok, YouTube and Facebook profiles, video portfolio, follower counts.
• Verification data: identity documents and selfie images submitted for creator verification.
• Business data: company information, brand details, team member invitations.
• Payment data: billing information and the data required by our payment processors (Stripe, dLocal) to onboard creators and process payouts. We do not store full payment card numbers ourselves.
• Communications: messages exchanged in chats, Deal notes, reviews, support requests, and inputs to the AI Agent.
• Content: files, images, video and audio that you upload as part of Deals or Campaigns.

1.2 Information collected automatically

• Technical data: IP address, approximate location (country), device type, browser, OS, language, time zone, referrer, pages viewed, session duration.
• Usage data: actions performed on the Platform, Deals viewed, Campaigns applied to, notifications received, online status.
• Cookies and similar technologies: for authentication, locale, security and analytics. See section 6.

1.3 Information from third parties

• Google OAuth: when you sign in with Google we receive your email, name and avatar.
• Social platforms: when you link a social account we may receive public profile data and follower counts.
• Payment processors: account status, payout results, and anti-fraud signals.

2. How we use your information

• Create and manage your account, authenticate you, and provide the Platform.
• Match Creators and Businesses, run Campaigns, manage Deals and process payouts.
• Power the AI Agent and AI-moderated chat (see section 3).
• Send transactional emails (deal updates, work-review reminders, payment notifications) and, with your consent where required, product or marketing emails.
• Detect, investigate and prevent fraud, abuse and security incidents.
• Comply with our legal obligations and respond to lawful requests.
• Measure and improve the Platform.

3. AI processing

CREOVA uses AI providers, including OpenAI and Anthropic, to power two features:

• AI-moderated chat: messages sent through the Platform may be scanned by AI moderation models to detect spam, abuse, off-platform contact attempts and other prohibited conduct. Moderation outcomes (including flags) are stored to operate, audit and improve the Platform.
• AI Agent: when you interact with the AI Agent, the prompts and relevant context (such as Campaign details or Creator metadata) are sent to the AI provider to generate a response.

Our AI providers process this data under their own contracts and do not, under our agreements, use it to train their public models. AI outputs may be inaccurate; you remain responsible for verifying them before acting.

4. Sharing your information

We share personal data with:

• Other Users: your public profile, applications, messages, reviews and Deal details are shared with the counterparties you interact with.
• Service providers (sub-processors):
  • Stripe, Inc. and dLocal — payments and payouts.
  • Google Cloud (including Cloud Storage) — hosting and file storage.
  • Google — OAuth authentication.
  • Mailchimp Transactional (Mandrill) — transactional and reminder emails.
  • Pusher — real-time messaging.
  • OpenAI and Anthropic — AI moderation and AI Agent.
  • Shopify — integration for stores connected to a Business account.
• Authorities: when required by law or to protect the rights, property or safety of CREOVA, our Users or the public.
• Corporate transactions: in case of merger, acquisition or asset sale, with appropriate safeguards.

We do not sell your personal data.

5. International transfers

CREOVA operates from the United States and our service providers process data in the United States and other countries. If you are located in Latin America, the European Economic Area, the United Kingdom or another jurisdiction with data protection laws, your information will be transferred and processed outside your country. We rely on appropriate safeguards (such as standard contractual clauses and provider data-processing agreements) for these transfers.

6. Cookies and similar technologies

We use cookies and similar technologies for: keeping you signed in, remembering your language preference, securing the session, preventing fraud, and basic analytics. You can manage cookies in your browser settings. Some features (such as login) will not work without essential cookies.

7. Legal bases

Where required by applicable law, we rely on the following legal bases:

• Performance of a contract: to provide the Platform, Campaigns, Deals and payouts.
• Legitimate interests: to secure the Platform, prevent fraud, improve our services and run AI moderation.
• Consent: for non-essential cookies and certain marketing communications.
• Legal obligation: to meet accounting, tax, anti-money-laundering and other requirements.

8. Your rights

Depending on your jurisdiction, you may have the right to:

• Access the personal data we hold about you.
• Correct inaccurate or incomplete data.
• Request deletion of your personal data.
• Object to or restrict certain processing.
• Request portability of your data.
• Withdraw consent at any time, without affecting the lawfulness of prior processing.
• Lodge a complaint with your local data-protection authority.

9. Data retention

We retain personal data for as long as your account is active and for the period necessary to fulfill the purposes described in this policy, comply with our legal, accounting and tax obligations, resolve disputes and enforce our agreements. When data is no longer needed, it is deleted or anonymized. Some operational logs (e.g. moderation logs) are kept for shorter, defined periods.

10. Security

We use technical and organizational measures, including encryption in transit, access controls and audit logging, to protect personal data. No system is fully secure; if we become aware of a security incident affecting your data we will notify you and the competent authorities as required by law.

11. Children

The Platform is not directed to children under 18, and we do not knowingly collect personal data from them. If you believe a minor has provided us data, please contact us so we can delete it.

12. Changes to this policy

We may update this Privacy Policy. Material changes will be notified through the Platform or by email before they take effect. The “Last updated” date at the top reflects the most recent version.
